Where Capable Co. processes personal data on behalf of a client as part of providing agreed business support services, the client will usually act as the data controller and Lee-Anne Burgess trading as Capable Co. will usually act as the data processor in relation to that processing.

Providing Capable Co. services
If you become a Capable Co. client, we process information as necessary to establish and manage our working relationship, provide the agreed services, communicate with you, administer your account and maintain appropriate business and contractual records.
Depending on the purpose, we rely on contract, steps taken before entering into a contract, legitimate interests or legal obligation.
Separate contractual terms, including the Client Agreement & Terms of Business, may apply to Capable Co. services.
Financial and administrative records
We process and retain appropriate invoices, payments, transaction information and other business records where necessary to administer Capable Co. and meet our legal, tax and accounting obligations.
Website administration, security and improvement
We may process limited information where reasonably necessary to operate and protect Capable Co., administer the website, understand how the business and website are being used and improve our services.

Banking and transaction information may be processed through Starling Bank and retained where necessary for accounting, tax and business-record purposes.
Third-party service providers
We use third-party services to help operate Capable Co. and provide our services.

email, documents, storage and business administration, including Google Workspace;
bookings and scheduling;
website analytics and search performance, including Google Analytics and Google Search Console;
banking and accounting, including Starling Bank;
project and business administration, including Asana;
design and content creation, including Canva; and
other systems reasonably required to provide agreed client services.
These providers may process personal information on our behalf or as separate data controllers, depending on the service involved.
We only share personal information where reasonably necessary for the relevant purpose, where required by law, or where you have otherwise authorised us to do so.
We do not sell your personal information.
Associates and authorised service providers
Capable Co. may use appropriately contracted self-employed associates or other authorised service providers to support the delivery of services where appropriate.
Where they require access to personal information, access will be limited to what is reasonably necessary for their role and appropriate confidentiality, data protection and security requirements will apply.
Where Capable Co. acts as a data processor on behalf of a client, the use of associates or other sub-processors will also be subject to the Client Agreement & Terms of Business, applicable data protection requirements and the client's documented instructions.
International data transfers
Some of the third-party services used by Capable Co. operate internationally and may process or store personal information outside the UK.
Where personal information is transferred outside the UK, we take reasonable steps to ensure that an appropriate lawful transfer mechanism or safeguard applies where required by UK data protection law.

How long we keep your information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet any applicable legal, contractual, insurance, tax or accounting requirements.
We review the personal information held by Capable Co. at least once each year and securely delete or anonymise information that is no longer required.
Some records need to be kept for longer. For example, financial and tax records are retained for the period required by HMRC, and relevant contracts and client records may be retained where reasonably necessary for legal, contractual or insurance purposes.
For a self-employed business, HMRC currently requires relevant business records to be kept for at least five years after the 31 January submission deadline of the relevant tax year.
Email subscriber information is retained while you remain subscribed. If you unsubscribe, limited information may be retained where necessary to ensure that your marketing preference continues to be respected.
Information that is no longer required will be securely deleted or anonymised where appropriate.
Information relating to enquiries or prospective clients who do not go on to work with Capable Co. will generally be reviewed as part of our annual data review and deleted or anonymised when it is no longer reasonably required, subject to any legal or legitimate business need to retain it.
Keeping your information secure
We take reasonable technical and organisational steps to protect personal information against loss, misuse, unauthorised access, alteration or disclosure.
This includes using appropriate account security, access controls and established third-party service providers.
Where associates or other authorised service providers require access to personal information, appropriate access controls, confidentiality and data protection requirements will apply.
